on Load Page I construct a datamenu with adding Items.
The last item of the datamenu is not displayed on IE9. No problem on ie8, FF, safari, ...
I find a workaround by adding a last item with visible=false ...

I followed the steps you suggested and was unable to reproduce the behavior you're describing. I created a sample using 10.3.20103.2105. I placed a WebScriptManager and WebDataMenu in the page and the in the Page_Load I constructed the menu by adding items. I saw the expected the results of the menu displaying properly will all items showing as well as their children when clicked or hovered over.
I have attached the sample project I used to test this. Please test this project on your PC; whether or not it works correctly may help indicate the nature of this problem.
If the project does not work correctly, this indicates either a problem possibly specific to your environment, or a difference in the DLL versions we are using. My test was performed using version 10.3.20103.2105 in NetAdvantage for ASP.NET 2010 Volume 3.
If the project does show the product feature working correctly, this indicates a possible problem in the code of your application. It will help if you can provide a small, isolated sample application that demonstrates the behavior you are seeing.
Or, if this sample project is not an accurate demonstration of what you're trying to do, please feel free to modify it and send it back, or send a small sample project of your own if you have one.

I just upgraded to latest release, and I don't see my problem with this release.
I meant to mention that this occurs if the items are added via markup. When I add them via code-behind the problem items shift so 7 and 9 don't show.
Using 11.1.20111.2158 I'm seeing the same "last time not rendered" but only if the number of items is 6 or 8, but all show it the menu has 7, 9, or 10. The menu gets "longer" for the extra item but the text is not visible and the item cannot be clicked. I've seen this in IE8 and IE7, but haven't tried others. It isn't an issue for me right now but would like to know if it is addressed in a service release. I'll update if I need to add more menus: the app only needs 5 right now.
Im using IE8 and Infragistics 12.1 Framework 4.0. I have a Master Page with a WebDataMenu. A page that extends from that Master Page, a Update Panel and inside a ASP .Net image button.
When a postback is produce all works fine except that the WebDataMenu do not render properly. It looses the style and the text menu is not align. The submenu also separtes from the parent menu causing that option can not be choose.
Surprise! My Master Page have this tags . If I do not use them my WebDataMenu works fine. Why? I do not know. I leave the doubt there...
