WebDataMenu and modal popup keeps menu open

When you open a non-modal popup through javascript executed on  web data menu item click, the  web data menu closes immediately as the window pops up.

When you open a Modal popup through javascript executed on web data menu item click, the web data menu does NOT close immediately as the window pops up, but stays there until you close the modal window.

We upgraded from v11.1 to v13.1 and started getting this behavior.
